This certifies that ________________________________, herein referred to as the Mare Owner, has engaged one breeding to
PAPA’S ROYAL DELIGHT (TWHBEA #984616 / IPWHR #1328) for the _2008_ breeding season (Oct, 2007 - Sept. 2008) in the amount of $_500.00__for the following mare:

Howe They Walk Farm, agent for the above named stallion, will herein be referred to as Breeder. This service is engaged subject to the following:
1. An amount equal to ˝ of the above breeding fee, plus all unpaid boarding expenses, will be due upon execution of this contract. The balance will be due within 60 days of the mare being declared "in foal" by a licensed veterinarian. Said mare is required to be examined by a licensed veterinarian within 30 days of the last breeding date.
2. A Photostat copy of registration papers shall be provided to Breeder with this contract. Worming and immunization data, as well as a copy of current Coggins test (within 12 months) shall accompany the mare upon arrival for breeding.
3. Mare
owner agrees each mare offered for breeding shall be in sound breeding condition
and free from any infection or disease. Any mare certified by an attending
veterinarian not to be in sound breeding condition shall not be bred. Mare owner
may substitute another mare within the same breeding season.
4. Should Stallion die or become incapacitated before Mare is first
serviced pursuant to this agreement, this Agreement shall be terminated and Howe
They Walk Farm shall return to mare owner the portion of the breeding fee paid
by mare owner, less any boarding and miscellaneous fees.
5. The Breeder agrees to diligently try to settle the above named mare
and shall have sole discretion of determining the best method of breeding such
mare. If the mare is not settled within two estrus cycles, mare owner agrees to
have the mare examined and cultured by a licensed veterinarian for possible
causes before rebreeding. If the mare does not settle within 3 estrus cycles, the Breeder
shall be held harmless.
6. Live Foal Guarantee: Live foal means the foal shall stand and nurse unassisted. It is understood that if the mare proves barren, aborts her foal, or if foal is stillborn, a return season will be guaranteed for the following year only, providing proper notification is given. Proper notification shall be defined as follows: Written certification by a licensed veterinarian within 14 days that the mare has slipped or produced a non-viable foal. Mare Owner certifies that such abortion or death did not result from any act or omission of the Owner subsequent to the mare's departure from Breeder.
7. Booster
rhinopnuemonitis (EHV-1) vaccinations must be
administered as indicated for pregnant mares by the individual drug
manufacturers,
as the mare
progresses throughout her pregnancy. Failure to do this will void the Live Foal
Guarantee.
8. Third year rebreeds are subject to any increases in the breeding fees.
There will be no live foal guarantee on third year rebreeds.
9. The breeding season in force for this contract shall begin October 1
of the preceding year, and close September 30th of the year dated on this contract.
10. Waiver of Liability: It is understood that the breeding farm, it's
owners, employees, and guests shall not be liable for any injury, escape,
disability, or death of any horse on its premises. The above named Mare Owner,
whose horse(s) is(are) under the care of Breeder, will not be liable or
responsible for any damage, injury or death to the breeding farm stallions,
employees, veterinarians, or other animals in the care of Breeder, whether or
not caused by his horse. WARNING - Under Missouri law, an equine activity
sponsor or equine professional is not liable for an injury to or the death of a
participant in equine activities resulting from the inherent risk of equine
activities.
11. Execution of this contract gives breeder the right to call in a licensed veterinarian to care for any deemed injury or illness of the mare, at our discretion while the mare is on premise. These veterinary costs will become payable prior to the mare leaving the facility. Howe They Walk Farm will make diligent effort to notify the mare owner of any injury or illness concerns as early as possible.
12. This contract is not valid unless completed in full. When Mare Owner signs contract, it will become a binding contract on both parties, subject to the above terms and conditions.
13. Breeding discount available for multiple mares by the same owner in the same season:
